WP Tango LLC – Terms of Service (TOS)

These Terms of Service (“Agreement” or “Terms”) govern your use of all web hosting, maintenance, and related services (collectively, the “Services”) provided by WP Tango LLC (“WP Tango,” “we,” “us,” or “our”). By signing up for or using our Services, you agree to these Terms. If you do not agree to these Terms, you may not access or use the Services. This document outlines your rights and responsibilities as a customer and details the boundaries and expectations of our service relationship in comprehensive, unambiguous terms.


1. Definitions

Client, Customer, or You: the individual or entity using the Services.

Account: the Customer account created to access Services.

Content: any data, media, or other information uploaded to or hosted on our Services.

Service Plan: the specific hosting or support package subscribed to.

Third-Party Services: services not operated by WP Tango but integrated or associated.

Force Majeure: uncontrollable events that prevent service fulfillment, such as natural disasters or internet outages.

2. Eligibility

  • Must be 18+ or legal age in your jurisdiction.
  • Provide accurate billing/contact details and keep them current.
  • Not prohibited from internet services by any applicable law.

Falsified registrations or unauthorized third-party signups may result in immediate suspension.

3. Scope of Services

We provide managed WordPress hosting including:

  • Containerized, high-performance infrastructure
  • Daily encrypted offsite backups
  • Core/plugin/theme updates
  • Full-stack optimization (Redis, caching, CDN)
  • Security hardening and malware monitoring
  • DNS setup and domain guidance

Advanced services (e.g., multisite, custom dev) may incur hourly billing or require a separate retainer agreement.

4. Uptime and Performance Commitments

We guarantee 99.9% uptime monthly, excluding:

  • Scheduled/emergency maintenance
  • Client-side code issues
  • External service failures

Infrastructure is optimized for single-core performance using CPUs like AMD Ryzen 7950X/9950X. In the event of SLA failure, partial service credits may be issued (see section 21).

5. Acceptable Use Policy (AUP)

Prohibited uses include:

  • Malware, phishing, or unauthorized mass email
  • Copyright infringement or illegal content
  • Crypto mining or heavy background processing
  • Use of nulled or insecure plugins/themes

Violation results in suspension or termination without notice. WP Tango may report criminal abuse to authorities.

6. Account Management

  • Use strong passwords and enable 2FA where possible
  • Update billing/contact info promptly
  • Restrict admin access to trusted users only
  • Report suspected breaches immediately

Security audits may be conducted to ensure compliance with best practices. WP Tango is not responsible for compromises due to client mismanagement.

7. Billing and Payment Terms

  • All services are prepaid (monthly, quarterly, or annually)
  • We may bill up to 14 days in advance of your renewal date
  • Late payments: Day 1 = reminder, Day 7 = suspension, Day 30+ = deletion

Refund Policy: No refunds for partial cycles unless explicitly stated. Credits may be issued for uptime failures.

Chargebacks: Filing disputes without contacting support may result in $50 fee and service termination.

8. Cancellations and Termination

Cancel anytime via dashboard or email. Retainer plans require 14 days’ notice.

  • Violations, non-payment, or abuse = immediate termination
  • Data retained for 7 days post-termination unless otherwise arranged

Export requests may incur fees for manual packaging and delivery.

9. Data Backups

  • Nightly backups retained 7–30 days based on plan tier
  • Includes full site files, database, and uploads
  • Restore requests fulfilled within 24 business hours

WP Tango performs periodic integrity checks. Clients should still maintain local backups. We are not liable for data loss due to client action or plugin conflicts.

10. Security and Software Updates

  • We handle critical core/plugin/theme updates
  • Use WAF, malware scanning, brute-force protection

You must: avoid pirated plugins/themes, use reputable sources, and notify us of security concerns. Remediation for negligence may be billed hourly.

11. Third-Party Services

WP Tango integrates with and supports the use of various third-party services such as content delivery networks (CDNs), SMTP relays, analytics platforms, performance tools, DNS providers, and others. While we may assist in configuration and troubleshooting, you acknowledge and agree that:

  • WP Tango does not control these third-party services and cannot guarantee their performance, availability, security, or compliance.
  • You are responsible for reviewing and complying with the terms and privacy policies of any third-party services you choose to use.
  • Any service failures, data loss, or outages caused by third-party integrations are not the responsibility of WP Tango.

WP Tango is not liable for third-party feature changes, pricing adjustments, policy shifts, or service discontinuation. Support for integrations may be withdrawn if a vendor becomes unreliable, unsupported, or introduces conflicts with our infrastructure.

12. Disclaimer of Warranties

WP Tango provides all Services on an “as is” and “as available” basis. We make no warranties or guarantees, either express or implied, regarding the reliability, availability, accuracy, or suitability of the Services for your particular needs.

To the fullest extent permitted under applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Non-infringement of intellectual property
  • Continuous, uninterrupted, or error-free service operation
  • Compatibility with all plugins, themes, or third-party platforms

You assume full responsibility for your use of the Services and acknowledge that downtime, interruptions, and support delays may occur.

13. Limitation of Liability

In no event shall WP Tango, its employees, contractors, officers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of revenue, profits, business, data, or goodwill
  • Service interruptions or delays
  • Security breaches or data exposure

WP Tango’s total cumulative liability for any claims arising out of or related to this Agreement shall not exceed the total amount you paid for Services during the three (3) months prior to the event giving rise to the liability.

14. Indemnification

You agree to indemnify, defend, and hold harmless WP Tango, its affiliates, employees, officers, agents, and contractors from any and all third-party claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the Services
  • Your violation of this Agreement, applicable law, or third-party rights
  • Content you upload, publish, distribute, or store via the Services

We reserve the right, at our own expense, to assume exclusive defense and control of any matter subject to indemnification.

15. Governing Law

This Agreement shall be governed and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Maricopa County, Arizona for the resolution of any disputes or claims.

You waive any right to participate in class actions, jury trials, or proceedings outside the designated jurisdiction.

16. Amendments

WP Tango reserves the right to amend these Terms of Service at any time. Material changes will be communicated via your client portal and/or email. Your continued use of the Services after such modifications constitutes your agreement to the revised Terms.

It is your responsibility to review these Terms periodically to remain informed about any changes.

18. Reseller and White Label Hosting Terms

If you are authorized by WP Tango to resell our Services, you are responsible for:

  • Supporting and billing your end users
  • Ensuring your customers comply with these Terms and all related policies
  • Managing DNS and infrastructure unless explicitly delegated to WP Tango

Resellers may not misrepresent WP Tango, circumvent payment systems, or overload servers. We do not offer direct support to end users of resellers unless specified. Abuse of reseller privileges may result in account termination.

19. Compliance Requirements

  • PCI-DSS: WP Tango does not store credit card information and is not a PCI-DSS certified provider. You are responsible for compliance if handling payments.
  • HIPAA: WP Tango is not HIPAA-compliant. Storing or transmitting protected health information (PHI) is not permitted.
  • GDPR: Clients with EU visitors must implement GDPR-compliant practices. WP Tango acts as a data processor and will honor access/deletion requests as required.

20. Staging and Development Environments

  • Staging environments are available for supported plans.
  • Inactive staging sites may be deleted after 30 days without notice.
  • Performance may differ from production; no uptime guarantee is provided for staging.

It is your responsibility to test changes in staging before deployment. WP Tango is not responsible for data inconsistencies between environments.

21. Service Level Agreement (SLA) Breach Handling

If WP Tango fails to meet the 99.9% uptime commitment (excluding permitted exclusions), clients may request a credit as outlined below:

  • Uptime between 99.0% – 99.89%: 5% credit
  • Uptime between 98.0% – 98.99%: 10% credit
  • Uptime between 97.0% – 97.99%: 20% credit
  • Uptime below 97.0%: 30% credit

All requests for SLA credits must be submitted within 15 days of the end of the affected month and include relevant logs or reports. Approved credits are applied toward future invoices and are non-refundable, non-transferable, and may not be exchanged for cash.

22. CDN, Caching, and Optimization Policies

WP Tango employs layered performance tools to ensure fast global load times:

  • Full-page caching and object caching (e.g., Redis)
  • Asset optimization via integrated CDN partners
  • Minification and lazy loading (as supported by site configuration)

You agree not to install conflicting performance plugins or disable our optimization stack without approval. Excessive bypassing of caching layers or custom rules that disrupt server efficiency may result in throttling or restriction of Services until resolved.

23. Data Portability and Export Assistance

Upon cancellation or request, WP Tango will provide:

  • A downloadable archive (.zip) of your site’s files and database
  • Optional migration assistance to a third-party host (fees may apply)

We retain terminated account data for up to 7 days unless requested sooner. After this period, backups and files may be permanently deleted. It is your responsibility to download and verify export data prior to final termination.

24. Support Channels and Priority Response

Support is available during business hours via email or the client portal. For urgent issues (e.g., downtime), 24/7 escalation is available on supported plans.

  • High Priority: Downtime, security breach – response within 2 hours
  • Medium Priority: Site errors, failed updates – response within 24 hours
  • Low Priority: Plugin advice, performance requests – response within 48 hours

Support does not include in-depth customization, plugin configuration, or content-related tasks unless covered by a retainer.

25. AI, Automation, and Monitoring Tools

WP Tango uses AI-driven tools to:

  • Monitor uptime and performance
  • Detect unusual traffic patterns
  • Optimize caching and system usage

By using our Services, you consent to basic monitoring of your website for performance and security metrics. We do not sell or share this data with external parties beyond infrastructure providers critical to your hosting environment.

26. Migration Terms and Downtime Risk

WP Tango provides complimentary migration assistance for most WordPress sites. Clients are responsible for:

  • Pointing DNS correctly once migration is complete
  • Testing all frontend and backend functionality post-migration

WP Tango is not liable for temporary inconsistencies during DNS propagation or plugin incompatibilities discovered after migration. Complex sites may require additional review or development billed at our standard rate.

27. Content Ownership and Intellectual Property

You retain ownership of all content uploaded to WP Tango-hosted sites. You are solely responsible for ensuring that your content:

  • Complies with applicable law
  • Does not infringe on third-party intellectual property
  • Is free of malicious code or copyrighted material without license

We reserve the right to remove or disable access to content that violates these standards or upon receipt of a valid DMCA request.

28. Feedback and Suggestions

By submitting suggestions or feature requests to WP Tango, you grant us the right to use such input to improve our Services with no obligation to compensate you or maintain confidentiality. We appreciate customer feedback and strive to enhance the platform accordingly.

29. Entire Agreement

This Agreement, along with any signed addendums, policies (including our Privacy Policy and AUP), and order forms, constitutes the entire understanding between WP Tango and the Client. No oral statements, email communications, or informal agreements shall override the terms of this Agreement unless formally amended in writing and signed by both parties.
